利用規約 Terms of Service

第1条(適用)

本規約は、ユーザーが当社の提供する金融情報サービス「Plus」(以下「本サービス」といいます)を利用するにあたり適用されるものとします。ユーザーは、本サービスを利用することにより、本規約に同意したものとみなされます。

Article 1 (Application)

These Terms apply to all users of the financial information service "Plus" (the "Service") provided by us. By using the Service, the user is deemed to have agreed to these Terms.

第2条(サービスの内容)

1. 本サービスは、株式、ETF、FX(外国為替)、暗号資産に関する価格情報、チャート、財務データ等の金融関連情報を提供するサービスです。

2. 本サービスは情報提供のみを目的としており、投資助言、投資勧誘、金融商品の売買の仲介または代理を行うものではありません。

3. 本サービスで提供される情報は、いかなる金融商品の売買を推奨するものではなく、投資判断の最終決定はユーザー自身の責任において行うものとします。

Article 2 (Description of the Service)

1. The Service provides financial information including prices, charts, and financial data for equities, ETFs, foreign exchange, and crypto assets.

2. The Service is for informational purposes only. It does not constitute investment advice, solicitation, brokerage, or agency for the trading of financial products.

3. Information provided by the Service does not recommend the purchase or sale of any financial product. All investment decisions are the sole responsibility of the user.

第3条(利用登録)

1. 本サービスの利用を希望する者は、本規約に同意の上、所定の方法により利用登録を申請し、当社がこれを承認することで登録完了となります。

2. 登録内容に虚偽が判明した場合、当社は登録を取り消すことができるものとします。

Article 3 (Registration)

1. To use the Service, an applicant must agree to these Terms, apply through the designated method, and obtain our approval. Registration is complete upon our approval.

2. If any registered information is found to be false, we may revoke the registration.

第4条(有料サービス)

1. 本サービスには、無料で利用できる機能と、月額料金をお支払いいただくことで利用できるプレミアム機能(以下「有料サービス」といいます)があります。

2. 有料サービスの料金、支払方法、提供内容等は、本サービス内に別途表示するものとします。

3. 有料サービスはサブスクリプション(定期購読)形式で提供され、ユーザーが解約手続きを行うまで自動的に更新されます。

Article 4 (Paid Services)

1. The Service offers both free features and premium features available through a monthly subscription fee (the "Paid Service").

2. Fees, payment methods, and the contents of the Paid Service are displayed separately within the Service.

3. The Paid Service is provided on a subscription basis and renews automatically until the user cancels.

第5条(返金ポリシー)

1. 有料サービスの料金は、理由の如何を問わず、原則として返金いたしません。

2. 有料サービスの購入後、サービス内容に不満がある場合、技術的な問題が発生した場合、その他いかなる理由においても、既にお支払いいただいた料金の返金には応じかねます。

3. サブスクリプションを解約した場合でも、既に支払済みの期間については引き続きサービスをご利用いただけますが、日割り計算による返金は行いません。

4. App Storeを通じた購入については、Appleの返金ポリシーが適用される場合があります。

Article 5 (Refund Policy)

1. As a general rule, fees for the Paid Service are non-refundable, regardless of the reason.

2. We do not provide refunds of fees already paid, whether due to dissatisfaction with the Service, technical issues, or any other reason.

3. If a user cancels a subscription, the user may continue to use the Service for the remainder of the paid period; however, no pro-rated refunds are made.

4. Purchases made through the App Store may be subject to Apple's refund policy.

第6条(投資に関する免責)

1. 本サービスは金融情報の提供のみを行うものであり、当社は金融商品取引業者、投資助言業者、または金融商品仲介業者ではありません。

2. 本サービスで提供される情報に基づいてユーザーが行った投資判断および売買取引について、当社は一切の責任を負いません。

3. 本サービスで提供される情報の正確性、完全性、有用性、適時性について、当社は保証いたしません。

4. 金融商品の価格は変動するものであり、投資元本が保証されるものではありません。ユーザーは、自己の判断と責任において投資を行うものとします。

5. 本サービスの利用により生じた損失、損害(直接的損害、間接的損害、逸失利益を含むがこれに限らない)について、当社は一切の責任を負いません。

Article 6 (Disclaimer Regarding Investment)

1. The Service provides only financial information. We are not a registered financial instruments business operator, investment adviser, or financial instruments intermediary.

2. We bear no responsibility for any investment decisions or trades made by the user based on information provided by the Service.

3. We do not guarantee the accuracy, completeness, usefulness, or timeliness of information provided by the Service.

4. Prices of financial products fluctuate, and principal is not guaranteed. The user invests at their own discretion and risk.

5. We disclaim all liability for any loss or damage (including but not limited to direct damages, indirect damages, and lost profits) arising from the use of the Service.

第7条(情報の出典と更新)

1. 本サービスで提供される金融情報は、第三者の情報提供元から取得したものを含みます。

2. 情報の更新頻度や遅延については、情報提供元の状況により異なる場合があります。

3. リアルタイムと表示されている情報であっても、実際の市場価格とは差異が生じる場合があります。

Article 7 (Sources and Updates of Information)

1. Financial information provided by the Service includes data obtained from third-party providers.

2. The frequency and delay of updates may vary depending on the source.

3. Even information labeled as "real-time" may differ from actual market prices.

第8条(禁止事項)

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはならないものとします。

• 法令または公序良俗に違反する行為
• 本サービスで取得した情報を商業目的で再配布する行為
• 本サービスのシステムに不正にアクセスする行為
• サービス運営を妨害する行為
• 他のユーザーまたは第三者の権利を侵害する行為
• その他、当社が不適切と判断する行為

Article 8 (Prohibited Acts)

The user shall not engage in any of the following while using the Service:

• Acts that violate laws, regulations, or public order and morals.
• Redistributing information obtained through the Service for commercial purposes.
• Unauthorized access to the systems of the Service.
• Acts that interfere with the operation of the Service.
• Acts that infringe on the rights of other users or third parties.
• Any other acts that we deem inappropriate.

第9条(利用停止・登録抹消)

当社は、ユーザーが以下のいずれかに該当する場合、事前の通知なく利用停止または登録抹消を行うことができます。

• 本規約に違反した場合
• 登録情報に虚偽が判明した場合
• 料金の支払いを怠った場合
• その他、当社がサービスの利用継続を不適切と判断した場合

Article 9 (Suspension and Termination)

We may suspend the user's access or terminate the registration without prior notice if any of the following applies:

• Violation of these Terms.
• Discovery that registered information is false.
• Failure to pay applicable fees.
• Any other case where we deem continued use inappropriate.

第10条(免責事項)

1. 本サービスに起因または関連してユーザーと第三者との間に生じた紛争について、当社は一切責任を負いません。

2. 天災、システム障害、外部攻撃、情報提供元の障害等によりサービスが停止または中断される場合がありますが、これにより生じた損害について当社は責任を負いません。

3. 当社は、本サービスがユーザーの特定の目的に適合すること、期待する機能・正確性・有用性を有すること、継続的に利用できることを保証しません。

Article 10 (Disclaimer)

1. We bear no responsibility for any disputes between the user and third parties arising in connection with the Service.

2. The Service may be suspended or interrupted due to natural disasters, system failures, external attacks, or issues with information providers. We are not liable for damages caused by such events.

3. We do not warrant that the Service is fit for the user's particular purpose, that it has the expected functionality, accuracy, or usefulness, or that it will be continuously available.

第11条(サービス内容の変更・終了)

1. 当社は、ユーザーへの事前通知なく、サービス内容を変更または終了することができます。

2. サービスの終了に伴い、有料サービスの利用期間が残っている場合であっても、当社は返金の義務を負わないものとします。

Article 11 (Modification and Termination of the Service)

1. We may modify or terminate the Service without prior notice to users.

2. Upon termination of the Service, even if a Paid Service period remains, we are under no obligation to issue refunds.

第12条(規約の変更)

当社は、必要と判断した場合、本規約を変更できるものとします。変更後の規約は、本サービス上への掲示により効力を生じます。

Article 12 (Changes to These Terms)

We may modify these Terms when we deem it necessary. The modified Terms take effect upon being posted within the Service.

第13条(準拠法および管轄裁判所)

本規約の解釈・適用には日本法を準拠法とし、本サービスに関して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Article 13 (Governing Law and Jurisdiction)

These Terms shall be interpreted and applied under the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any dispute arising in connection with the Service.
